Cook County Releases “Property Tax Portal Website”

This month, Cook County released its new “Property Tax Portal” website, that allows the public to search multiple databases for property tax information at once. This new website provides a “one stop shop” for taxpayers to access information about their property tax assessments, payment status, and about any related real estate tax sales on the property.

Cook County Board President Toni Preckwinkle had this to say about the new website:

“This portal has been a collaborative effort with a number of different county offices, working together to offer convenience and efficiency to Cook County taxpayers. With the launch of the new site today, residents will, for the first time, have a streamlined process to handle their property tax issues, and we are excited to be able to provide this kind of enhanced service.”

Supreme Court of Florida Applies Jones v. Flowers and Vacates Tax Deed

On March 8, 2012, the Supreme Court of Florida issued an opinion in a tax sale / tax deed matter that challenged the notice given in a tax deed proceeding. The Clerk of the Court failed to mail notice to the latest assessee of record. The owner challenged the issuance of the tax deed on Due Process grounds. The Court held that “where a notice sent by certified mail is returned undeliverable, the clerk of court must take additional reasonable steps to notify a titleholder of the upcoming tax sale.” The Court set aside the tax deed because the Clerk violated the owner’s Due Process rights.

Supreme Court of West Virginia issues opinion regarding the notice required in tax sale / tax deed proceedings

On March 1, 2012, the Supreme Court of Appeals of West Virginia issued an interesting opinion in a tax sale / tax deed matter that challenged the statutory Take Notices in West Virginia as well as the effect of a bankruptcy proceeding on a tax sale. Strangely, neither the owners nor the lender raised any Due Process violations. The case was remanded to the trial court. If this case arose in Illinois, it may have implicated the Indemnity Fund provisions of the Illinois Property Tax Code.
